Orange County Trial Attorney Gregory G. Brown Obtains $523,250 Jury Verdict for Real Housewives of Orange County Star Gretchen Rossi in Stalking and Assault Trial

On November 15, 2012, an Orange County jury awarded Real Housewives of Orange County reality TV star Gretchen Rossi $ 500,000 in compensatory and $ 23,250 in punitive damages against Jay Photoglou, according to the jury verdict. Photoglou was found liable for Stalking, Assault, Intentional Infliction of Emotional Distress, Conversion, Intentional Interference with Contract, and Intentional Interference Prospective Economic Advantage. The claims included Photoglous threats to kill Rossi, multiple assaults, submitting nude photos to Internet sites, harassment, and other wrongful conduct, based on the evidence presented at trial.

Photoglou also had a lawsuit against Rossi for libel, slander, and false light, according to his First Amended Complaint, seeking $ 1,000,000 in damages. The jury found against Photoglou on all of his defamation claims against Rossi, as established by the jury verdict.

Photoglou’s suit was filed in January 2010. Rossi’s was filed in June of 2010. According to court documents, the two cases were consolidated and trial began on October 22, 2012 in Orange County Superior Court case numbers 30-2010-00365771 and 30-2010-00393514.

The History

The issues began when Photoglou announced to the world on February 10, 2009 that he was Rossis real boyfriend and that her engagement to Jeffrey Beitzel was staged for the show, according to the evidence presented at trial. Within hours, Photoglou had gone to the National Enquirer, who ran his story, as also demonstrated by the evidence at trial. Rossi’s trial testimony recounted three separate death threats by Photoglou on November 18, 2008, February 18, 2009 and March 4, 2009. Rossi obtained a Temporary Restraining Order against Photoglou on March 5, 2009, according to court documents.

The Trial

The trial testimony revealed multiple death threats by Photoglou, stalking, online harassment, 911 calls, claims of suicide attempts, and posting of nude photos of Rossi. The parties filed numerous police reports, according to the evidence at trial. There were multiple claims by Photoglou that Rossi and Slade Smiley had assaulted him. The documentary evidence in trial indicated that Photoglou had also enlisted the help of many other associates and bloggers to virtually track Rossis every move to harass her and interfere with her career.

The trial evidence included 3 prior restraining orders against Mr. Photoglou, showing a 22-year pattern of harassing, stalking, and threatening women he knew, according to court documents.

In finding against Photoglou, the jury did not believe there was the relationship Photoglou claimed. During trial, he was repeatedly referred to as “obsessed” with Rossi, according to the trial transcripts. Attorney Gregory G. Brown said, “Photoglou testified in his deposition that he had been engaged to Rossi.” At times during the trial, Photoglou began to cry during his testimony.

Global Renewables Industry at Tipping Point as it Seeks to Reduce Reliance on Subsidies

The renewable energy industry is at a tipping point as the developed markets start to close the door on generous subsidy programs and emerging markets develop cost strategies to compete with fossil fuels according to Ernst & Youngs latest quarterly global Renewable energy country attractiveness indices report released today.

Gil Forer, Ernst & Youngs Global Cleantech Leader, comments: Current global macroeconomic drivers are reinforcing the role of emerging markets in the future global energy mix. As renewable energy technologies become more cost-competitive, the importance of government subsidies is set to decrease to create a sustainable growth platform for both developed and emerging markets, as well as manufacturers.

The indices provide scores in 40 countries for national renewable energy markets, renewable energy infrastructures and their suitability for individual technologies. During Q3 2012, China remained at the top of the All Renewables Index (ARI), but dropped a point as its solar sector continued the consolidation process in an effort to boost domestic installation and rationalize government support, which could slow growth in the more immediate term. In recent months China has also seen a large outflow of Chinese investment in favor of markets such as Africa and South America.

The quarter also saw the US drop 1.5 points in the ARI, resulting in Germany moving up into second place ahead of the US. While the German government has recently increased the countrys renewable energy target for electricity to 40% by 2020 and is proactively implementing policy measures to create sustainable growth, the downgraded score reflects the more immediate changes around possible subsidy caps for solar, wind and biomass.

Within the US, the uncertainty about long term US energy policy combined with concerns over the extension of key renewable energy incentives and the availability of low-priced natural gas are likely to continue slowing the growth in the sector in the short to medium term, particularly in the wind sector.

However when looking towards the long-term, Forer comments: Now that the US elections are behind us, we can likely expect new long-term momentum behind cleantech related regulations, such as EPA greenhouse gas regulations as well as Department of Energy and Department of Defense energy efficiency initiatives.

Clean energy investment hit by uncertainty

Globally, total clean energy investment fell 5% in Q3, to US$ 56.6b, with investor enthusiasm dampened by skepticism over policymakers renewable energy commitments and the continued decrease in solar and wind technology costs impacting on total investment values.

New investment levels have varied globally with investment in Europe, Middle East and Africa rising 7% to US$ 21bn in Q3 mainly driven by solar thermal and wind project financings in Morocco. However, in the same period, investment in the Americas and Asia-Pacific slipped by 25% and 3%, to US$ 10.4b and US$ 25.2b respectively.

Ben Warren, Ernst & Young Energy and Environmental Finance Leader comments: Political and regulatory uncertainty, working in tandem with constrained capital markets, continue to put the brakes on investment and deal volumes. Looking forward, market restructuring and the emerging secondary infrastructure financing market are likely to provide the momentum for future investment.

Emerging markets get back to basics

Having taken note of the lessons learnt across markets in Europe and the US, where high levels of subsidization have been the key driver of growth in the sector, governments in emerging markets are driving business models that work without direct subsidies or grants that could potentially compete head-on with conventional fossil fuel sources.

The latest indices include Saudi Arabia and United Arab Emirates (UAE) for the first time, reflecting the growing presence of the Middle East within the clean energy market, with the UAE ranked 35th in the index, two places above Saudi Arabia. The roll-out of solar initiatives places the UAE over Saudi Arabia in the Solar Index, while the reverse is true in the Wind Index based on natural resource.

When looking at the global outlook for the clean energy industry, Forer summarizes: While the reliance on government subsidies is decreasing, it should not be forgotten that until grid parity is reached in more regions, financing will still depend on the timing and nature of individual countries incentives and support regimes, a commitment to invest in grid infrastructure and connectivity, and the ability of projects to seek multiple partnerships and investors.

Jonestown Survivor Speaks Out After 30 Years

Teri Buford O’Shea was the last person to escape Peoples Temple, three weeks before the Jonestown massacre that killed 918 people in November 1978. Now, shes speaking out about the tragedy and her own survival in her new book Jonestown Lullaby: Poems and Pictures (published by iUniverse).

Written over the years in journals and on scraps of paper, hidden away and later found by OSheas daughter, Jonestown Lullaby is bringing to light years worth of personal, revealing poetry and vivid photographs of life in the Peoples Temple community. OShea, a personal confidant to leader Jim Jones for seven years, brings readers a look into Jonestown with poetic passion, recounting stories of innocent lives lost and remembering those who helped her live again after her flight.

My story starts at the beginning of my life, not Jonestown, says OShea. My life didnt begin with Jonestown, and it will not end with it. The book is a testament to this, and is really a tribute to survivors from all walks of life.

When OShea began writing poetry at the age of 7, she never imagined her talent would lead her to compose pieces reflecting tragedy, fear and survival. In addition to losing her community, OShea struggled with the guilt of survival, living in hiding for years following the tragic event.

Turning to her writing for help along her journey back to a normal life, she says poetry is how she becomes one with her emotions. Providing a rare account of post-traumatic stress, OSheas poems reflect her nightmares of the past 30 years, her moment of terror at gunpoint when she refused to tell Jones she loved him, and also about her journey toward piecing her life back together.

I am not the sum of my traumas, says OShea. I have a spirit that lives. Many books are read and cherished because they reflect a certain time or event in history. I hope this book will be one of them.
